Question, what if a singer is being paid to sing, say in a nightclub and they sing one of your songs. Are they then profiting from your song? This is an area I know nothing about and I know it is off topic.
To be clear on the music, you can "cover" the song (that is, you can play the song) as long as you give the credit to the original writer (and/or performer because the writer and performer are not always the same.) However, if you use the song(s) as a way to set a tone for an establishment (like a restaurant) you are then required to have a license for the music and you must pay a fee. No need to go into the details here, but I hope you get the idea.

At CGW, we share a lot of information that is NOT copyrighted in any way and all Members benefit accordingly! However, we are very careful to be sure that proprietary or confidential information is not shared unless written permission is granted by the owner (or posted by the owner) such as Paul at C5.

I think I know what im talking about .... talking points are great if there true ..they never are ...

its amazing when you get to know people who think the greatest talent there is ...is no talent at all and still live like kings .... sheesh I always felt sorry for these people as there brainwashed to feel that way .....and know no other pleasure than that ... what a way to go through life trying to buy controlling intrest on someone elses talent ....
 
as for the question about a Local Musician playin' a cover tune in a club........ here is how this works... I have been a member of B.M.I. in Nashville for 30 years or more . a writer Must be a member of one of the 3 company's to ever promote a piece of Music , or to ever be payed for anything like that . as long as the singer Don't Claim the music as his own , it's not Illegal to sing it anywhere ... BUT yes it is Illegal to be payed to perform it without permission from the writer , BUT .... Royalties ... are 6.6 cents a minute . so...... the average song is 3 & 1/2 minutes long , and comes out to be about .20 everytime its played . its the only job of B.M.I. , and the other 2 co. to collect the Royalties from Radio & TV , and send it to the writers on each quarter . they can't sit in a club and count every song , that some poor Musician plays just tryin to make a living... soooo they go after the business owner , and they just do a seat count , and they charge them for every seat , filled or not . . no matter what kind of business you have , if there is Music playing everyday , and they can prove your business draws in more customers by the music ... they can make the owner pay a fee. like Joe says , its Not Right . its BIG Business .
