If a person is using Medicaid for healthcare, there is already a lien against any valuable property (house, bank accounts, life insurance, etc) that person owns. Medicaid won't go after a pre-paid burial plan, but all else is fair game.
For years, I told my mother-in-law she should sign over her place to one of her kids (not me) to protect it from Medicaid seizure after she died. She refused, saying she didn't want to give her home away. When she died, Medicaid had over $79,000 in healthcare claims against the place. The place was sold by a realtor to satisfy the claims. Luckily, one of my children was the high bidder, so the place stayed in the family.
Medicaid ain't free if you own anything valuable!!
